Overheard a lawyer say most corporate cases settle because the evidence is too messy to admit in court

Is that actually true or just something they tell themselves to justify pushing for a deal? I figured most cases settled because of cost, not because the other side's proof gets thrown out on technicalities.

Didn't I read somewhere that like 95% of all lawsuits settle before trial? I heard a retired judge on a podcast say it's usually a mix of everything - cost, risk, and yeah, sometimes the evidence just isn't clean enough to rely on.

Yep, that sounds about right.
